TERMS AND CONDITIONS
Letter of agreement concerning the provision of photographer services between Shootme Photo and The Client/Couple.
Definition of Client/s
The individual(s) whose signature(s) are documented below shall be recognized as the client(s) for this contract. They will receive Shootme Photo's products and assume financial responsibility for all contractual payments. This agreement encompasses the full agreement between the involved parties, and any amendments must be documented in writing and signed by both Shootme Photo and the client(s).
Service Coverage - Wedding
The parties agree that Shootme Photo will provide photo event coverage services (from the preparation up to the wedding ceremony, and end of the reception program). In the event the client exceeds the hours of the coverage or extend the coverage after the end of the reception program, an additional charge of Php 5,000/hour shall apply.
The team will arrive at the preparation location 5 hours prior official wedding ceremony time. Any requests with a custom timeline can be discussed with the team.
House Rules
Shootme Photo is bound by the event guidelines. The Client agrees to accept the technical results of the imposition. Shootme Photo will offer technical recommendations and always perform what is necessary without compromising the event. The Client also acknowledges that Shootme Photo will exercise creative freedom, capturing the event with the team's unique visual perspective and style. Requests for specific shots or replication of photos taken by other photographers/photography companies will be open for discussion.
Pre-wedding/Prenup Photo Session
Our prenup and engagement photo session includes eight(8) hours of shooting time, allowing for up to three wardrobe changes. Should the client exceed the agreed-upon coverage time, an additional charge of Php 2,000 per hour will apply. If an extra day is required for the prenup shoot, a fee equivalent to 50% of the prenup shoot rate will be assessed.
The team will arrive at the preparation location one hour before the scheduled start time of the prenup shoot.
Out of the country Pre-wedding/Prenup Photo Sessions rates and service coverage are open for custom arrangement.
Image Editing
Shootme Photo will only process the number of images included in the package, limited to global adjustments and color grading. Additional charges apply for liquify, pimple retouches, and extensive photo manipulation requests per image.
We prioritize maintaining the authenticity of the images, so excessive manipulation requests are not accepted. If technical limitations prevent Shootme Photo from fulfilling a manipulation request or meeting the Client's expectations, the Client acknowledges that Shootme Photo has done its best and holds no further responsibility for the final outcome.
Limit of Liability
Shootme Photo ensures the delivery of high-quality photographs in compliance with the regulations of the event location. In the event that Shootme Photo is unable to fulfill the contract due to unforeseen circumstances such as injury, illness, acts of God, terrorism, or other uncontrollable situations, the team will make every effort to secure a replacement photographer who will meet the obligations with the same level of expertise and in accordance with Shootme Photo's standards.
In cases where Shootme Photo experiences photo loss resulting from factors beyond its control, such as corrupted files, camera malfunctions, or other unforeseeable events, attempts will be undertaken to recover all lost files. Should a complete loss of files occur, a refund equivalent to the package payment may be issued, and as a gesture of goodwill, Shootme Photo offers a complimentary re-shoot as compensation.
Requirements
The Client is responsible for securing and arranging any permits, clearances, or approvals required for photography at the event venue or any other location included in the coverage if necessary. This may include, but is not limited to, shooting permits, venue permissions, entrance passes, parking access, and other location-specific requirements.
Crew meals or food allowances are already included in our package, so providing meals for our team is not required. However, if the Client would like to provide a meal for the photography team during the event, it would be greatly appreciated and will help keep our team energized throughout the day.
Cancellation
IN THE EVENT CLIENT FAILS TO MAKE ANY OF THE PAYMENTS REFERENCED BY THE DEADLINE SET FORTH IN THE CONTRACT, SHOOTME PHOTO HAS THE RIGHT, BUT ARE NOT OBLIGATED TO PURSUE ANY OR ALL OF THE FOLLOWING REMEDIES:
(1) Terminate the agreement (2) Forfeit the reservation fee (3) Immediately stop all work-in-progress or hold the materials until the payment has been made.
- CANCELLED SERVICES WITHIN 2 MONTHS BEFORE THE EVENT WILL BE SUBJECT TO FORFEITURE OF THE 50% OF THE PAYMENT OR THE CLIENT IS REQUIRED TO SETTLE 50% OF THE SELECTED PACKAGE
- CANCELLED SERVICES WITH NO ADVISE FROM THE CLIENT WILL BE SUBJECT TO FORFEITURE OF THE DEPOSIT AND REQUIRED TO SETTLE THE 50%OF THE SELECTED PACKAGE
- CHANGING OF DATES ARE ACCEPTED BUT MAY REQUIRE RE-BOOKING FEE OF PHP5,000 IF MOVED WITHIN ONE (1) MONTH BEFORE THE EVENT WITHOUT PRIOR NOTICE.
- RE-BOOKING FEE EXEMPTIONS: ACTS OF GOD AND UNFORESEEN CIRCUMSTANCES, PANDEMIC RELATED CONCERNS.)
Force Majeure
If performance of this Contract or any obligation under this Contract is prevented, restricted, or interfered with by causes beyond either party’s reasonable control (“Force Majeure”), then the obligations of the party invoking this provision shall be suspended to the extent necessary by such event. The term Force Majeure shall include, without limitation, act of God, act of terrorism or other similar occurrence, pandemic, national emergencies, or other cause that is beyond the control of Shootme Photo, Shootme Photo responsibility and liability is limited to the return/refund of the payment of unfulfilled contracted services.
Responsibilities
Shootme Photo disclaims responsibility for any compromised coverage resulting from factors beyond its control, such as disruptive guests, client or guest tardiness, inclement weather, scheduling issues, inaccurate address information, decoration rendering, or location restrictions. Moreover, Shootme Photo cannot be held accountable for suboptimal backgrounds or lighting that may hinder photo quality. Shootme Photo is not held liable for missed coverage of any part of the event/s due to failure to turn over information.
Copyright & Image Usage
It is agreed that Shootme Photo and the Client shall co-own the copyright to all images created under this contract.Shootme Photo may reproduce and use the images for the Client’s personal use, as well as for the photographer’s portfolio, samples, self-promotion, editorial purposes, studio displays, website, social media, and other promotional materials.
We also respect our clients’ privacy. Upon request, the Client may opt for non-posting of their wedding photos, in which case Shootme Photo will not publicly share or post the images online or on social media.
Completion Schedule
- All raw and edited photos will be delivered within 15 days after the event, with possible adjustments during the peak wedding season.
- Album orders will consist of the client's selected photographs. (100 photos for the Prenup album / 200 photos for the wedding album). An upload link will be provided for the submission of selected photos.
- Album deliverables are within 6-8 months timeframe.
Payment Policy
A deposit of PHP 10,000.00 is required to secure the event coverage service specified in the package. This fee is non-transferrable to other clients and non-refundable in the event of cancellation. However, it may be applied to a rescheduled event, subject to availability of Shootme Photo. Partial payment of 50% of the remaining balance is due on the day of the pre-wedding/prenup photo session if availed. Otherwise, the full remaining payment for the package is expected on or before the event day.
